BOOKING TERMS & CONDITIONS.

It is imperative that you thoroughly review and comprehend the "Booking Terms and Conditions" presented below, as they encompass vital information pertaining to your legal rights, responsibilities, and remedies. Any booking made with Gig Travel Group must only be executed upon comprehension and acceptance of the outlined Booking Terms and Conditions.
 

The terms "Gig Travel" and "Gig Travel Group" refer to the registered trade names for Gig Travel Group PTY LTD. In the context of these Booking Terms and Conditions, references to "us", "we", "our", "Gig Travel" and/or "Gig Travel Group" shall pertain to Gig Travel Group Pty Ltd operating as Gig Travel Group PTY LTD. The terms "you" and "your" as used in these Booking Terms and Conditions shall denote the customer.

By engaging in any booking process with our Agency, you pledge to abide by and be bound by these Booking Terms and Conditions. These Booking Terms and Conditions apply to any bookings initiated through our consultants (in-person, over the phone or by email or text) as well as online bookings made on our website or through any online booking tools or channels.

Our terms and conditions will: 

(i) Be provided to you before you enter into a sale with us; 

(ii) Require you to acknowledge that you have received and accepted our terms and conditions; 

(iii) Include a Schedule of Fees of any fees we charge you; 

(iv) Be distinguishable from marketing or promotional material; 

(v) Be in English and any other language we consider to be appropriate to our customer base; 

(vi) Be consistent with this Code; 

(vii) Advise you of our obligations to protect the confidentiality of your information; and 

(viii) Provide you with information about our complaints handling policy and other dispute resolution procedures available under ATAS.


We shall rely on the authority of the individual initiating the booking to act on behalf of all other travelers included in the booking, regardless of whether separate payments have been made by the other travelers, and that individual shall be held responsible for binding all such travelers to these Booking Terms and Conditions.

It is imperative to note that under all circumstances, all travelers (or individuals making travel bookings on their behalf) are required to present evidence of a valid passport for international travel. Many countries mandate a minimum of six months validity from the date of return, and some countries mandate the possession of a machine-readable passport. For international travel bookings, it is the responsibility of the traveler to inform us if they possess less than six months validity on their passport or if they do not possess a machine-readable passport. Failure to comply with passport regulations may result in denied entry to the destination country, and we shall not be held liable for any costs incurred as a result. It is highly recommended to verify the passport requirements of your destination country before making any travel arrangements.

 

In the context of all international bookings, it is assumed that all travelers included in the booking possess a valid Australian passport that meets the requirements for entry to the destination and any transit points. Should this assumption not be accurate, it is the responsibility of the traveler to inform us accordingly. It is of utmost importance that travelers ensure they possess valid passports, visas, and re-entry permits that comply with the requirements of immigration and other government authorities. Any fines, penalties, payments or expenses incurred as a result of non-compliance with the aforementioned documents and requirements shall be the sole responsibility of the traveler (excluding instances where the non-compliance is a result of fault on our part).

Should you require information pertaining to visa, passport, and other travel document requirements for your trip, kindly inform your consultant. We can provide general information on visa and passport requirements that apply to international travel bookings made with us. Our consultants can also obtain more specific information from an external visa advisory service provider on your behalf, should you desire. We are also able to assist in obtaining visas through this external service, with applicable fees. For online bookings, you may contact an external visa provider such as Visa Link (https://visalink.com.au/) directly. It is highly recommended to verify and obtain the necessary travel documents well in advance of the trip to avoid any inconvenience or denied entry to the destination country.


We make no guarantees regarding the correctness, accuracy, or appropriateness of the information provided by any external service provider, and shall not be held liable for any loss or damage incurred as a result of reliance on such information (excluding instances where the loss or damage is a result of fault on our part).

For individuals traveling to the United States, it is imperative to visit https://esta.cbp.dhs.gov for essential and mandatory information regarding the mandatory pre-registration for the visa waiver program (“ESTA”). At present, Australian passport holders will not be permitted entry into the United States without a valid ESTA (or visa). It is worth noting that eligibility requirements for ESTA may not be met, and a visa may be required.

 

Similarly, for individuals traveling to Canada, it is important to visit http://www.cic.gc.ca/english/visit/eta.asp for crucial information regarding the mandatory electronic travel authorisation for visa-exempt foreign nationals (“ETA”). As of March 15, 2016, Australian passport holders will not be permitted entry into Canada without a valid ETA (or visa or permit). It is worth noting that eligibility requirements for ETA may not be met, and a visa or permit may be required. It is highly recommended to verify and obtain the necessary travel documents well in advance of the trip to avoid any inconvenience or denied entry to the destination country.

It is strongly advised that you apply for an ESTA or ETA prior to booking any airfare, in the event that you have doubts regarding your eligibility for an ESTA or ETA. The processing time for visas, ETAs, ESTAs, and permits can vary greatly, ranging from instantaneous processing to several weeks, months, or even years.


Travelling Documentation:
Travel documents, including but not limited to airline tickets, hotel vouchers, and tour vouchers, are utilized to confirm arrangements with travel service providers. These documents may be subject to certain conditions and restrictions, such as non-refundability, non-date-changeability, and the potential for cancellation or change fees. The transfer of travel documents to another individual is strictly prohibited. All airline tickets must be issued in the name of the passport or photo identification holder and any errors in the provided name may result in an inability to use the booking, cancellation, and the imposition of additional fees. It is imperative to thoroughly review travel documentation for errors in names, dates, and timings and to promptly inform us of any discovered discrepancies. If reservations were made through a consultant, it is the responsibility of the individual to collect all necessary travel documents prior to departure.

Kindly reach out to your consultant to confirm the availability of your travel documents for pick-up. For individuals who have made reservations via our online platform, it is imperative to retain either the electronic copy or a printed version of your travel documents as supplied by our website or through a subsequent email correspondence. Please make sure to retain the most recent version of the said documents.

We strongly advise you to thoroughly review your travel documents to familiarise yourself with the baggage allowances, as they may differ among airlines and countries. Should you exceed the allotted baggage (if permitted by the airline), it is your responsibility to cover any additional costs associated with it. Please note that we cannot be held liable for any expenses, fees, penalties, costs, liabilities, damages or losses related to baggage allowances or excess baggage. Additionally, please be aware that any excess baggage purchased at the airport may be subject to inflated rates and are at the discretion of the airline or supplier.


Travel Insurance:
You should ALWAYS travel with the appropriate level of travel insurance.

We fully endorse the advice provided by the Department of Foreign Affairs and Trade regarding the importance of obtaining travel insurance for all overseas travel. It is highly recommended that you secure appropriate travel insurance coverage for your travel arrangements. At a minimum, your insurance should provide protection for travel cancellation, medical and repatriation expenses, personal injury, accidents, death, loss of personal baggage and money, and personal liability insurance. Should it be requested by us or prior to any booked travel, evidence of insurance coverage must be presented to Gig Travel Group. Please be advised that insurance coverage offered by credit card companies or reciprocal medical cover agreements may not be comprehensive. Your consultant can provide general information regarding travel insurance options. For specific information on services provided by travel insurers, including quotes, please refer to the Financial Services Guide (“FSG”)/Product Disclosure Statement (“PDS”) of the relevant travel insurer.

We are authorised representatives of CoverMore Insurance Services Pty Ltd (ABN 95 003 114 145, AFSL 241713) ("CoverMore") and receive financial and non-financial compensation for the sale of CoverMore travel insurance products through our agency. We, along with CoverMore, are authorized to provide general advice and arrange travel insurance products on behalf of the insurer, Zurich Australian Insurance Limited (ABN 13 000 296 640, AFSL 232507).

It is imperative that you thoroughly review the CoverMore Combined FSG/PDS prior to purchasing any CoverMore travel insurance product to ensure it meets your needs and financial situation. The Combined FSG/PDS also includes information regarding the conditions, limits, and exclusions that apply to the insurance, the 15 working day cooling-off period, and how to access CoverMore's privacy policy and complaints handling procedures.


TRAVEL ADVICE INCLUDING COVID-19 (CORONAVIRUS) GUIDANCE:
It is advisable to consult the Department of Foreign Affairs and Trade (DFAT) or visit their official website, www.smartraveller.gov.au, for general travel information as well as specific recommendations pertaining to your intended destination, including any safety alert levels. Additionally, it is highly recommended to register your travel itinerary with DFAT to ensure efficient communication in case of an emergency.

It is of the utmost importance that individuals familiarize themselves with the current developments and updates regarding Australia's immigration and border regulations during the ongoing COVID-19 pandemic, which can be accessed through the official website, https://covid19.homeaffairs.gov.au/. Furthermore, it is imperative that individuals adequately educate themselves on the airline industry's regulations concerning passenger safety, including the mandate for face masks and the requirement to present evidence of a negative COVID-19 test for both transit and final destination passengers. It is important to note that this information is subject to change without prior notification, and it is the responsibility of the traveler to stay informed of the relevant policies implemented by airlines and government entities at the time of booking, as the travel date approaches, and immediately prior to embarking on the journey.

As you are aware, by choosing to travel during the ongoing COVID-19 pandemic and its variants, as well as other viral or infectious diseases, you may be exposed to these health risks. It is imperative that you familiarize yourself with all relevant travel information, including any associated health hazards. By making the decision to travel, you acknowledge that you have fully considered this information and assume full responsibility for the risks associated with traveling at this time. Please be advised that to the fullest extent permitted by law, we cannot be held liable for any additional risks that may arise. Additionally, it is important to follow the guidance of the health authorities and the local government and to comply with the health protocols that are in place for the destinations you are visiting. It is also advisable to take out travel insurance that covers health risks.


Health and Safety when travelling:
It is of the utmost importance that you familiarize yourself with any health requirements and recommended precautions that are relevant to your travel itinerary, and that you ensure that you have all necessary vaccination documentation on hand. In certain circumstances, failure to present the required vaccination documentation may result in being denied entry into a country. To ensure that you are fully prepared for your journey, we strongly recommend that you seek the advice of your personal physician, a travel medical service, or a specialized vaccination clinic prior to commencing your travel. Furthermore, general health advice for your intended destination can be obtained by consulting the Department of Foreign Affairs and Trade (DFAT) website, www.smartraveller.gov.au. Additionally, it is important to keep in mind that health regulations, travel restrictions and quarantine requirements are subject to change and it is your responsibility to stay informed and compliant with the current rules and regulations of the destination you are visiting.

It is important to note that the accommodation of any medical requests, including, but not limited to, access to power, refrigeration, and the use of mobility aids, is solely at the discretion of the travel service provider and is subject to a variety of factors, such as the mode of transportation and local standards at the destination. These medical requests are beyond our control and while we will forward all requests to the travel service provider as a file note, we cannot guarantee that they will be accommodated. It is your responsibility to directly follow up with the travel service provider, both at the destination or prior to travel where feasible, to ensure that your medical needs will be met during your trip. Additionally, it is advisable to inform the travel service provider of your medical needs and requirements at the time of booking, to ensure that your travel arrangements are tailored to your specific needs. Furthermore, it is important to have all the necessary documentation and certifications required by the travel service provider and the destination's authorities to support the medical needs.

Prices Presented:
It is important to note that all prices are contingent upon availability and may be withdrawn or altered without prior notice. The price of the booking will only be guaranteed once full payment has been received from you. Please be advised that the prices quoted are subject to change, as they may be affected by various factors beyond our control which increase the cost of the product or service. These factors include, but are not limited to, unfavourable currency fluctuations, fuel surcharges, taxes, and increases in airfare. To ensure that you have the most current and accurate information, we recommend that you contact your consultant for updated prices before finalizing your booking. Furthermore, it is advisable to check the terms and conditions of your booking and to read carefully the information provided by the travel service provider regarding the prices, taxes, fees and charges that may apply to your trip.

Service Fee's:

Service fees apply to all travel services booked in accordance with the established fee schedule for each individual customer. These fees are negotiated directly with the customer and must be accepted in advance of any transactions taking place. For example, the cost of re-issuing a domestic airline ticket is charged per person, per ticket, and may include sector or booking fees in accordance with the established schedule of fees. Additionally, any changes, modifications, or cancellations to the original booking may incur additional fees as outlined in the service schedule. It is the responsibility of the customer to review and fully understand the fee schedule before agreeing to any transactions and making payments. Any questions or concerns regarding the fee schedule should be addressed directly with the travel service provider before finalising the booking. It is important to note that any fee's charged are in addition to the fare of the ticket and taxes imposed by the government.


Supplier Financial Agreements:
We are compensated through a variety of means, including commissions, financial incentives, and other financial arrangements, for arranging travel and travel-related products and services on your behalf through third-party providers. It is important to note that by law, we are not obliged to disclose the nature or value of these financial arrangements to you. However, it is important to be aware that these financial arrangements may influence the recommendations and advice provided by us, and that it is our responsibility to ensure that any such arrangements do not compromise the impartiality of the advice and recommendations we provide. Additionally, we are committed to providing you with transparent and accurate information about all the costs and fees associated with the travel services we provide to you and to disclose any conflicts of interest that may arise.


Deposits & Final Payments:
Upon booking, you will be required to pay a deposit or multiple deposits as advised by your consultant. It is important to note that, subject to your rights under the Australian Consumer Law, all deposits are non-refundable for changes of mind or cancellations made by you, or if the travel service provider's terms and conditions dictate that the deposit is non-refundable. In the event that the deposit is refundable, it is contingent upon Gig Travel Group receiving the funds from the travel service provider or receiving authorisation from the travel service provider to refund the deposit. Additionally, it is important to note that while a deposit secures your booking or seat, prices quoted may change prior to the final payment. Final payment is due no later than six weeks prior to departure, unless otherwise specified. Some airfares or services may require payment in full at the time of booking. It is advisable to review the terms and conditions of your booking and to read carefully the information provided by the travel service provider regarding the deposit, prices, taxes, fees and charges that may apply to your trip.


Changes & Cancellation fee's:

It is important to note that, subject to your rights to a refund and remedy under the Australian Consumer Law, the following fees apply if we make any changes or cancel any bookings, including online bookings and bookings made with a consultant, at your request:
 

  • Changes to domestic/Trans-Tasman bookings will incur a fee per passenger per booking as outlined in your service agreement, in addition to any fees imposed by the supplier.

  • Cancellations to domestic/Trans-Tasman bookings will incur a fee per passenger per booking as outlined in your service agreement, in addition to any fees imposed by the supplier.

  • Changes to international bookings (excluding Trans-Tasman bookings) will incur a fee per passenger per booking as outlined in your service agreement, in addition to any fees imposed by the supplier.

  • Cancellations to international bookings (excluding Trans-Tasman bookings) will incur a fee per passenger per booking as outlined in your service agreement, in addition to any fees imposed by the supplier.


In case you wish to change or cancel flights that were booked online, you may contact us at (03) 7042 6757. Any fees for such changes or cancellations must be made via credit card and will be subject to the applicable credit card surcharges. It is important to note that all bookings are made on your behalf subject to the terms and conditions imposed by the travel service provider. If, for example, a travel service provider's terms and conditions contain a "no refund policy," we will only be able to provide you with the remedy provided by the travel service provider (if any), which may include a travel credit supplied by the travel service provider. It is advisable to check the terms and conditions of your booking and to read carefully the information provided by the travel service provider regarding the prices, taxes, fees and charges that may apply to your trip and any change, modification, or cancellation fee's.

 

Supplier Charged Change & Cancellation fee's:

It is important to note that altered or cancelled bookings, regardless of the reason, may also incur supplier fees, which can reach up to 100% of the cost of the booking, even if travel has already commenced. These supplier fees may also apply in the case of changes to a booking or re-issuance of tickets or documents. Should we incur any liability for a supplier change or cancellation fee for any booking that is altered or cancelled, you agree to indemnify us for the amount of that fee or charge. In instances where a refund is sought for a changed or cancelled booking for which payment has been made to the travel service provider, we will not provide a refund until we have received the funds from the travel service provider. This process can often take 12 weeks or longer, depending on the supplier's processing time. In the event that we are still in possession of the funds, we can only provide a refund once we have received authorisation from the travel service provider to process the refund, and subject to the travel service provider's change or cancellation policy. Additionally, it is important to note that refunds on flights booked via a credit card may be subject to a fee imposed by the credit card company.


Additional cancellation details:

While we will make every effort to accommodate any changes to your booking, it may not always be possible. Any changes made to the booking will be subject to any applicable travel service provider fees and Gig Travel Group change fees as outlined above, and you will be responsible for any increases in pricing that may result from your change request. In the event of a cancellation, you will forfeit all deposit/s and will be required to pay any applicable travel service provider fees and Gig Travel Group cancellation fees as outlined above. We will provide you with a refund for any remaining funds (if applicable). Refunds for deposits or bookings are subject to Gig Travel Group receiving the funds from the travel service provider or receiving authorisation from the travel service provider to refund the deposit or booking funds. For bookings that are instant purchase or non-refundable, if you cancel any aspect of your booking, you will not be entitled to a refund, travel credit, or other remedy from the travel service provider and/or Gig Travel Group. It is important to review the terms and conditions of your booking and to read carefully the information provided by the travel service provider regarding the prices, taxes, fees, charges, refund, and cancellation policies that may apply to your trip before finalising the booking.


When the Supplier Cancels your travel:

The following terms apply to a cancellation made by a travel service provider, with the exception of unavoidable or extraordinary circumstances, which will be outlined separately.

To the extent permitted by applicable law, if your booking is cancelled by a travel service provider, the travel service provider will generally offer you, in the first instance, alternative travel arrangements of comparable standard if available (and will refund any price difference if the alternative is of a lower value), or a travel credit for the full amount paid by you. Alternatively, subject to the travel service provider's change or cancellation policy, the travel service provider may offer you a refund of all money paid by you in respect of the booking, from which the travel service provider and/or Gig Travel Group will deduct any unrecoverable costs and any applicable travel service provider fees and Gig Travel Group cancellation fees set out above.

It is important to note that "unrecoverable costs" refers to all reasonable, direct, and indirect costs incurred by us in relation to your booking, which includes amounts paid by Gig Travel Group to other relevant travel service providers who are responsible for components of your booking and which may be non-refundable, such as costs paid to overseas in-destination tour or transfer operators.

For bookings that are instant purchase or non-refundable, if your booking is cancelled by a travel service provider, subject to the travel service provider's change or cancellation policy, you may not be entitled to a refund


Extraordinary Circumstances, our unavoidable circumstances:

In the event of unavoidable or extraordinary circumstances, a travel service provider may be compelled to materially modify or cancel your booking as outlined below.

In these Booking Terms and Conditions, "unavoidable or extraordinary circumstances" refers to any cause that is outside of a travel service provider's reasonable control and could not have been prevented or avoided even if all reasonable measures had been taken by the travel service provider. These circumstances may include, but are not limited to: war, threat of war, riot, civil disturbances, industrial dispute, terrorist activity and its consequences, plague, epidemic, pandemic, infectious disease outbreak or any other public health crisis (including quarantine or other employee restrictions), natural or other disaster (such as volcanic ash or hurricanes or similar events), nuclear incident, fire or bushfires, adverse weather conditions (actual or threatened, including snow and fog), closed or congested airports or ports or other modes of transport, unavoidable technical problems with transport, unforeseen alterations to transport schedules, transportation disruptions or cancellations, domestic and/or international travel restrictions, changes to travel advisories and restrictions, changes to health advisories and quarantines, changes to immigration, labour, and free-movement laws resulting from BREXIT, rescheduling of aircraft or boats or other modes of transport, changes to applicable laws and/or other government mandates (including evacuation orders and border closures), and similar events.

A material modification is defined as one that has a significant impact on your booking and would cause substantial inconvenience to you, including but not limited to: a change of departure date, departure point or airport, or change of departure time of more than twelve hours. It is important to note that in these cases, the travel service provider will make every effort to provide you with alternative arrangements or offer a refund of the money paid for the booking, but these are subject to the travel service provider's change or cancellation policy and any applicable fees or charges.

 

If your booking is cancelled due to an un-avoidable or extraordinary circumstance:

If your booking is cancelled due to unavoidable or extraordinary circumstances, the travel service provider may offer you a refund, subject to the travel service provider's change or cancellation policy. The travel service provider may offer you a refund of all money paid by you in respect of the booking, from which the travel service provider and/or Gig Travel Group will deduct any unrecoverable costs, and any applicable travel service provider fees, and Gig Travel Group cancellation fees as outlined above. Alternatively, the travel service provider may offer you a credit on hold.

It is important to note that "unrecoverable costs" refers to all reasonable, direct and indirect costs incurred by us in relation to your booking, and includes amounts paid by Gig Travel Group to other relevant travel service providers who are responsible for components of your booking and which may be non-refundable, such as costs paid to overseas in-destination tour or transfer operators. It is also important to note that the final decision on the refund or credit on hold is subject to the travel service provider's change or cancellation policy and any applicable fees or charges.

 

Payment via credit card:

In accordance with industry standards, a surcharge will apply when making payments by credit card. The surcharge rates are as follows: 1.5% for Visa and MasterCard, 2% for American Express, and 3.5% for Diner's Club or International Credit Cards. By providing us with your credit card or debit card information, you authorize us to charge all fees incurred by you in relation to the services provided by us to the designated card. Should payment not be received from the card issuer or its agents for any reason, you are obligated to pay the outstanding amount immediately upon demand. To protect against potential fraudulent use of credit cards, you agree to indemnify us against any loss that may be incurred as a result.

For your convenience, we offer the option to securely store your credit card information for future transactions. However, if you choose to do so, you have the right to remove your saved credit card information at any time.


Cash Transactions:
We do not accept any Cash payments.   

 

EFT Transactions:

Please be advised that payments made via Direct Deposit may take up to three business days to fully process. Therefore, if you choose to make payment in this manner, it is imperative that you do so at least three business days prior to the date on which payment is due. Once payment has been made, it is essential that you notify your assigned travel manager and include any relevant invoice or booking reference numbers in the payment reference. Additionally, kindly provide a remittance of the payment to your travel consultant or finance manager. To ensure prompt and accurate processing of your payment, we recommend verifying all information provided and double-checking the accuracy of your deposit before submission.


Airline Taxes:
Airline taxes are subject to change and can only be confirmed at the time of issuance of the airline ticket. Additionally, please be advised that some airports may also charge a local tax. These taxes are calculated in the local currency and are subject to fluctuation based on the exchange rate. Please keep in mind that these taxes are beyond our control and subject to change without notice. It is the traveler's responsibility to stay informed and up to date with the latest information regarding taxes for their specific destination at the time of booking, prior to departure and upon arrival.


Service Guarantee:
In accordance with the Australian Consumer Law, our booking and advisory services are guaranteed to be provided with due care and skill, to be reasonably fit for the specified purpose, to reasonably be expected to achieve the desired result, and to be provided within a reasonable time. In the event that we fail to meet any of these guarantees, you as the consumer have certain rights and remedies under the Australian Consumer Law. It is important to note that these guarantees apply to the services we provide and not to the services provided by third party travel service providers. Additionally, please be advised that these guarantees do not affect any other rights or remedies that may be available to you under any other law.


Travel Agency / Travel Services Provider:
All bookings made through our agency are made on your behalf, subject to the terms and conditions imposed by the respective travel service providers. These terms and conditions may include, but are not limited to, conditions of carriage, cancellation policies, and limitations of liability. As the legal rights in connection with the provision of travel services are against the specific travel service provider, and not against our agency, it is crucial that you familiarize yourself with the terms and conditions provided by the travel service provider before making a booking. Our agency can provide you with copies of these terms and conditions upon request, and we strongly advise that you review them carefully to ensure that they meet your needs and expectations. Additionally, please note that in the event of any issues or concerns arising during your travel, your rights are against the travel service provider and not our agency, except where the issue is caused by fault on our part.

As an agency, we act as a facilitator in arranging travel related products and services on behalf of various transport, accommodation and other service providers. We take care in selecting reputable providers, but have no control or liability over the services provided by these third-party providers. It is the responsibility of the customer to review and familiarize themselves with the terms and conditions, including conditions of carriage, cancellation policy and limitations of liability, imposed by these travel service providers. Any legal rights in connection with the provision of travel services should be directed towards the specific provider and not towards our agency, unless the issue is caused by a fault on our part.

Liability:

To the extent permitted by law, neither Gig Travel Group Pty Ltd nor any of its related bodies corporate, directors, officers, employees, servants or agents accept any liability for any injury, damage, loss, delay, additional expense or inconvenience caused directly or indirectly by the acts, omissions or default, whether negligent or otherwise, of third-party providers over whom we have no direct control, force majeure or any other event that is beyond our control or that is not preventable by reasonable diligence on our part. Our liability is also limited by any relevant international conventions, such as the Montreal Convention in relation to air travel, the Athens Convention in relation to sea travel, the Berne Convention in relation to rail travel, and the Paris Convention in relation to accommodation. Under circumstances where our liability cannot be excluded and where liability may be lawfully limited, such liability is limited to the remedies required of us under applicable law (including the Australian Consumer Law). This liability clause is subject to your rights under the Australian Consumer Law and nothing in these Booking Terms and Conditions is intended to limit any rights you may have under the Competition and Consumer Act 2010 (Cth).

 

Loyalty and Frequent Flier Bookings:

We kindly request that you inform our consultants of any frequent flyer or other loyalty program membership details at the time of booking. If you are making your reservation online, please ensure to provide these details in the designated field. Please be aware that it is your responsibility to verify the terms and conditions of your specific frequent flyer or loyalty program membership, as we cannot guarantee the accrual of points or any additional benefits such as status credits or lounge access for your booking.

Last Minute Schedule Changes:
We recommend that you contact the airline to confirm your scheduled departure time 24 hours prior to your flight.


Monies not held in Trust:

You agree and acknowledge that any monies paid by you to us will not be held in trust on your behalf and may be held in any account as we see fit, including with our own and/or other customer monies. Such monies will be considered the property of Gig Travel Group Pty Ltd and will be considered a debt due and payable to the travel service provider in accordance with the payment terms agreed upon between us and the travel service provider. It should be noted that payment will generally be made to the travel service provider prior to the services being provided, however, in certain cases, payment may only be made after the services have been provided. In regards to monies paid for flights with an IATA airline, such monies may be held in trust for that IATA airline in accordance with the payment terms agreed upon between us and the IATA airline. In the event that we are still holding the monies, we can only provide a refund once we have been authorised by the travel service provider to process the refund, and it is subject to their change or cancellation policy.


Ticket Consolidation / External Ticket Issue:
Gig Travel Group may at times utilise ticketing services through external Ticketing Consolidators such as but not limited to companies such as Express Tickets or Air Tickets. You agree that Gig Travel Group will co-ordinate ticketing on travel reservations within the relevant terms and conditions of the Ticketing Consolidator: EG (https://www.airtickets.com.au/Page/Terms%20and%20Conditions) 

Modifications to Terms and Conditions:
We reserve the right to make amendments to these Booking Terms and Conditions at any time without prior notice. Any modifications made will be reflected on the www.gigtravel.com.au website, applications, or services, and will be effective upon posting. Please be advised that the terms and conditions that apply to your booking are those that are in effect at the time of the booking being made with us. It is your responsibility to review these terms and conditions prior to making any booking with us to ensure that you are aware of any changes.


Governing Laws:
In the event of a dispute arising between you and us, the laws of Australia shall govern and be binding upon all parties. Any legal action or proceeding arising out of or related to these Booking Terms and Conditions shall be instituted in the courts of Australia and you hereby irrevocably and unconditionally submit to the exclusive jurisdiction of such courts, waiving any objection that you may have to the venue, jurisdiction or inconvenience of such courts." It is further specified that the disputes must be resolved in accordance with the laws of Australia.

You acknowledge and confirm that you are of legal age, being 18 years or older, and that you have read, understood and agree to the terms and conditions outlined in the above Booking Terms and Conditions and our Privacy Policy.
